This policy explains how WeBuyMotorcars collects, uses, and protects your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

WeBuyMotorcars ("we", "us", "our") operates the online vehicle marketplace at webuymotorcars.co.za. We act as the Responsible Party as defined under POPIA.

We collect only what is necessary to provide our services:

  • Account information: Full name, email address, phone number, WhatsApp number
  • Dealer information: Business name, physical address, province, city, VAT number
  • Vehicle listings: Vehicle details, photos, pricing, mileage, and condition
  • Payment information: Subscription payments are processed by Yoco. We do not store card numbers on our servers.
  • Usage data: Pages visited, search queries, browser type, IP address (for security and analytics)
  • Communications: Lead enquiries submitted through listing pages

3. How We Use Your Information

  • To create and manage your account
  • To publish and manage vehicle listings
  • To process subscription payments via Yoco
  • To facilitate buyer-seller communication (leads)
  • To send transactional emails (account confirmation, password reset, subscription notices)
  • To improve site functionality and detect fraud
  • To comply with legal obligations

We will not use your personal information for unsolicited direct marketing without your consent, in accordance with POPIA Section 69.

4. Sharing of Personal Information

We share your information only where necessary:

  • Yoco (Pty) Ltd — payment processing. Subject to Yoco's own privacy policy at yoco.com/za/privacy-policy
  • Hosting provider — your data is stored on servers in South Africa or within the jurisdiction of our hosting provider
  • Buyers and sellers — when you submit a lead or a seller responds, contact details are shared between the two parties
  • Legal authorities — where required by law, court order, or to protect our rights

We do not sell personal information to third parties.

5. Security

We implement reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, disclosure, or destruction. Passwords are stored using strong one-way hashing. Payment card data is handled entirely by Yoco and is never stored on our servers.

6. Retention

We retain personal information only for as long as necessary to fulfil the purpose for which it was collected, or as required by law. Account data is retained while your account is active and for up to 5 years after closure for legal and auditing purposes.

7. Your Rights Under POPIA

As a data subject, you have the right to:

  • Request access to the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your personal information (subject to legal retention obligations)
  • Object to the processing of your personal information
  • Lodge a complaint with the Information Regulator of South Africa
